These Terms are between you and Develemit LLC, an Arizona limited liability company doing business as DevelEmail ("Develemit," "we," or "us"). By creating an account or using DevelEmail you agree to them, together with the Acceptable Use Policy, Privacy Policy, and Data Processing Agreement. If you accept on behalf of a company, you confirm you have authority to bind it.
You must be at least 16 years old to use DevelEmail.
Keep your credentials secure. You are responsible for activity under your account and API keys, and must tell us promptly of any unauthorized use.
We provide email sending, delivery tracking, and related tools. We may change or discontinue features, and we do not guarantee that mail will be delivered to or accepted by any recipient mailbox provider.
You must comply with the Acceptable Use Policy. We may suspend or terminate accounts that violate it, including immediately where needed to protect deliverability or IP reputation.
You own your content and recipient data. You grant us the limited rights needed to host, process, and send it to provide the service. You are responsible for having the right and the consent to send it.
Fees are charged according to your plan. Fees are non-refundable except where required by law.
You may stop using the service at any time. We may suspend or terminate your access for breach of these Terms or the AUP. On termination, your data is handled as described in the Privacy Policy and DPA.
The service is provided "as is" and "as available," without warranties of any kind to the extent permitted by law.
To the maximum extent permitted by law, our total liability arising out of or related to the service is limited to the fees you paid us in the 12 months before the claim arose, or $100 if you paid no fees. We are not liable for indirect, incidental, special, or consequential damages.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws rules.
Before starting any arbitration or court action, the parties must try to resolve the dispute informally for 30 days after one party sends written notice to the other. Send notice to us at [email protected].
Disputes not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will be seated in Maricopa County, Arizona.
Either party may instead bring an individual claim in small-claims court if it qualifies.
Claims may be brought only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative proceeding.
We may update these Terms and will post the new version here. Questions: [email protected].
